Abu John Mathew is a disputes lawyer focusing on commercial litigation and insolvency, with particular expertise in matters arising from the financial services sector. Since joining the Bar in 2012, he has developed a strong practice in handling complex and high-value disputes.

He represents a wide array of clients and regularly appears for both Operational and Financial Creditors before the NCLT and NCLAT, advising on diverse insolvency and restructuring matters. His practice includes representing banks, financial institutions, NBFCs, and asset reconstruction companies in securitisation and debt recovery proceedings before the Hon’ble Supreme Court of India, the High Court of Delhi, DRAT, and DRT.   • Represent leading Indian Banks, financial institutions, and asset reconstruction companies in complex banking, insolvency, enforcement, and recovery proceedings across forums in India. Advises clients in matters under the Insolvency and Bankruptcy Code, 2016 and the SARFAESI Act, 2002, including initiation and defence of Corporate Insolvency Resolution Processes (CIRP), enforcement of security interests, restructuring disputes, lender–borrower litigation, and strategic recovery actions.

 

  • Led the litigation team in securing a landmark judgment before the Supreme Court of India on the interpretation of Section 18 of the SARFAESI Act. The Apex Court authoritatively held that a borrower filing an appeal is mandatorily required to deposit 50% of the “debt due” as claimed in the Section 13(2) notice, together with the interest claimed therein.

 

  • Advises financial creditors and institutional lenders on strategic dispute management, pre-litigation risk assessment, enforcement structuring, recovery strategy, and resolution planning. Provides comprehensive advisory on risk allocation, contractual interpretation, and dispute strategy under standard-form infrastructure and financing agreements.

 

  • Represents public sector undertakings and government bodies in high-stakes infrastructure arbitrations arising from Concession Agreements, EPC Contracts, O&M Contracts, and BOT Projects. Has assisted in international construction and infrastructure arbitrations in coordination with solicitors based in Dubai, including advisory on construction contracts, security structures, and cross-border dispute management.

 

  • Regularly appears before the Supreme Court of India, Delhi High Court, National Company Law Tribunal, National Company Law Appellate Tribunal, Debts Recovery Tribunal, and Debts Recovery Appellate Tribunal in high-value commercial and financial disputes. Regularly drafts and argues Company Petitions, Original Applications, Appeals, Writ Petitions, and Arbitration Petitions involving substantial financial exposure across infrastructure, real estate, banking, and corporate sectors.
